The courts in dallas must of been aware of the high courts decision! It has to be big news this takeover in the states as well! I think the courts have completly belittled the uk justice system and have given a big f!ck you to the english (just as you would expect from rednecks) this judge should have his title revoked! I am also disgusted that the football governing body be it the fa, premiereship or even fifa have stayed completly silent on this matter! Breaking News - The High Court has ruled that Texas was illegally stolen from Mexico in 1848 and must therefore be immediately returned to its rightful owner.
A decision on the amount that will have to be paid to Mexico to compensate for loss of income during the 162 years of the theft (plus interest) will be decided at a hearing tomorrow.
A spokesman for the Mexican Government offered his thanks to Liverpool and said that we could have any Mexican player(s) that we wanted on a free transfer in the January window.

Thats quite rich (or is it poor) the mess your club is in, was because you paid well over the odds in fees and wages for mediocre cr*p for years. Quality won't go to your club anymore. I don't really want to add fuel to the fire as I am not a Chelsea fan in anyway, but Chelsea's Russian appears to be a fan of the club he owns, who has backed his team with hard cash. You look at other Premiership teams and how many chairmen are fans of the club they run; not many. Liverpool have been miss-managed for years and squandered millions, just like many other teams in a quest for glory; Leeds and Portsmouth came close to going under; Liverpool almost did the same. I don't think you're a small club, as our Chelsea friend suggests, but I do think as a club you're not of the same stature as you once were and it's difficult to see without a sugar daddy, that you will ever get back to what you once were. {ed's note - the club makes big profits, profits which were swallowed up by debt repayments. Once those debt repayments are removed the club has plenty to spend and no need of a sugar daddy at all. I agree that a players weighted stats (eg: headers/ tackles won for a defender counting more than passes made/ / / / / goals and assists for a striker counting more than tackles won etc) should not be used to decide a manger on a player. But would there be any harm in an owner sitting in front of a manger and being able to say. . . .OK, you want to sign so and so and I trust you're judgement but his stats are awful, explain it to me. . . . It might have made our managers think twice about some of the duds we've had in the last 10 years, surely they couldn't have had good stats if playing in a decent league.

Ok i don't care who owns the club, but Sabermetrics should be introduced to the club.

sabermetrics is the analysis of baseball(sport) through objective evidence, especially baseball(sports) statistics that measure in-game activity.

If we start breaking the game down into objective stats, a team of average players should be able to win the league. The concept should be followed and tied into sports science and in game moitoring of situation.

The only thing that might not help us is. The pace of the game. In baseball the game is played over hours. This allows for stats and data to be collected in real time so that it can be used to help the team win. Football is much faster paced game, and data collection breakdown and applying could be difficult in real time. Although i believe the manager is powerless on the match days to effect the outcome. That the work has been done the week before or relie on talent on the pitch. This concept is intresting.

I would like to see if real time stats could effect the out come of a game, I remember back to man city game and we all saw that Agger get turned by wingers a few times before the goal came. Would a computer of been able to see the danager and make changes so that we won that game. I guess this concept is like getting a computer manager a sports team. Sabermetrics could be the future because is it much more than simple stat analysis after the game or a transfer recruitment tool i would really like to see he concept applied in real time game play.

Liverpool's owners were accused of "outrageous" behaviour on Thursday after they thwarted High Court orders allowing the club to be sold.

Mr Justice Floyd had given a ruling in London on Wednesday that meant the English directors of Liverpool could agree a £300 million takeover by John W Henry's New England Sport Group.

But before the board could make any decision on Wednesday night, Tom Hicks, one of the American owners, secured a temporary restraining order from a Texas court.

Mr Justice Floyd had totally rejected attempts by Mr Hicks and George Gillett to stand in the way of the sale in a ruling which should have left them helpless to intervene.

Both the Liverpool board and NESV believed a deal could be reached last night but the last ditch intervention by the American owners meant more court action was necessary.

The Royal Bank of Scotland, the club's main creditor, had won the injunctions on Wednesday that would have meant they would be paid back a £200 million loan which becomes due for settlement on Friday.

RBS returned to the High Court on Thursday afternoon seeking anti-suit injunctions to nullify decisions taken in the court in Dallas.

Richard Snowden QC, for the bank, said there were no legal representatives for Hicks and Gillett in court today although they had been informed of the latest move.

Mr Snowden said they had been forced to act because of "extraordinary events" following the High Court ruling.

He said the American owners had complied with the orders to restore the original directors of the Liverpool board but at the same time had launched a US action.

"About five minutes before before the board was due to commence the meeting at 1830 hours, solicitors for the companies were informed that relief had been obtained from a judge in Texas, purportedly on behalf of the three English companies (which control Liverpool).

"The Texas court seems to have been told remarkably little about the proceedings in this court."

He said the US court had also allowed an injunction to stop RBS exercising its right to recall its loan.

"This is the most outrageous abuse of process."

He said Hicks and Gillett had agreed for the sale process to continue in compliance with the order of the High Court and then they had taken action in the US in defiance Mr Justice Floyd's "clearly expressed intention".

"The proceedings in Texas are plainly inappropriate. This dispute involves an English football club and three English companies and has no connection with Texas other than that Hicks and Gillett may reside there.

"It is a plain attempt to frustrate and impede the proceedings."

He said the American owners had made "scurrilous allegations" against RBS in the Texas court which had no basis in fact.

Mr Snowden said granting anti-suit injunctions always ran the risk of an affront to a foreign court.

"But it is apparent the US judge himself was aware that what he was being asked to do might cause some ruffling of feathers in this jurisdiction

It is being claimed the American based Hedge Fund has acquired all of Tom Hicks' shares to go along with those of George Gillett, which it already owned.

It is further claimed that if they repay all outstanding loans to RBS before the set deadline, they will by default become the new owners of LFC, nudging out New England Sports Ventures.

However the Echo understands the move would not signal Hicks and Gillett returning to ascendancy in the battle for the Reds.

Instead it is believed Mill Financial, in turn owned by Springfield Financial who have links with the Washington Redskins American Football team, may be acting on behalf of another, as yet unnamed and unknown group who have put themselves in a position to move in at the 11th hour and take over the club.

Good to see some of us are staying optimistic (!). Look, RBS won't let the club go into administration, they will take control of the club instead and sell it straight away, probably to John Henry. Putting the club into administration is a hassle that the bank don't want. Also, it would be harder to sell the club if we go into administration as Henry said he would no longer be interested if this happened. RBS have fought the yonks this far and will just want the situation to be over with. Besides, they might not even get to the point where they need to take control, if the board can sort out this restraining order quick enough then Henry can buy the club before the bank has to intervene. Courts in the UK are justice driven, courts in the USA are finance driven, there view on justice is how much money can we make out of this case, they are not interested in UK law, the UK gov gave unparralelled powers to the USA, on financial matters, this is factual information, its not the club that will get prosecuted but the board and RBS, if they lose then H&G will re-gain control of LFC.

The UK judge has reconstituted the board and injuncted Hicks from interferring in the make up. The aim of this was to ensure the board could continue to function. By taking out an injunction in Texas Hicks has breached the judge's injunction preventing him from interferring with the board. This is contempt of court. The only real legitimate option open to Hicks yesterday was to await the sale to go through to NEVS and then to issue proceedings against the board members and RBS for damages resulting from the alledged sale at an undervalue. As ell as getting teh texas injunction lifted RBS should file an application in the UK courts asking that Hicks be committed for contempt of court. thei awoudl result in Hicks having to personally appear before the UK court to answer for his contempt. Reality Red"

It is only contempt of court if an injunction is taken out in the UK. H&G filed in Texas, so technically they are not in contempt. This is just mischief making and I feel, it is done to force the bank to call the loan and put Liverpool in administration. I also feel, if the Red Sox consorts were in the same position they would be doing the same as H&G. Americans, fair play and sport don't mix.

Fellow Reds, this is yet another antic from two desperate people trying to save money that has gone. The truth of the matter is that US Courts have no jurisdiction over UK proceedings unless there is a direct link.

In this case, there is none, Liverpool Football Club and Kop Holdings are registered in the UK. The ownership is totally around those two companies so there is no chance a US court can have any jurisdiction on the matter. As for the claim for £1b that can't succeed in USA because it relates to business in the UK. The only reason why the board are even given this any thought is because NESV and RBS have operations in the USA and they want to be seen to respect US Courts so will politely tell them you can't tell us what to do legally of course and have the injunction removed. Although, they could just go ahead with the sale it has no bearing on us.

Relax and just await the good news.

In my opinion liverpool are in a no lose situation here. okay, first senario is that this restraining order is squashed by the end of the week and liverpool is bought by NESV for the agreed price of £300m. senario 2 is that the order stands meaning we get a 9 point deduction and the bank take control of us. either way the club will be sold and maybe for less if senario 2 occurs meaning more money for players in january that will ensure we finish the season strong thus making the 9 point deduction irrelivent (lets face it we aint gettin 4th and does anyone really care about the europa league). on another note i believe that NESV are the best bidders as if it was just about money then other offers would have been taken. these guys may not be richest but they have the know how and the contacts to develop us further on and off the pitch. Everyone needs to calm down! This is purely a legal matter now. No amount of sending emails to Obama or Cameron will really make any difference. Courts make decisions all the time that are contrary to what politicians would like to see happen. It is called the separation of powers.

However, do not fear. The next step for the directors/ RBS/ NESV is to have this injunction removed and to get a permanent stay of the proceedings (ie case) in Texas. This is basically a permanent injunction against the courts in Texas hearing the case there. Courts generally do not like there to be parallel cases running at the same time based upon the same set of facts. I think there is a good chance that a UK court would make a stay order because the UK is clearly the most appropriate jurisdiction for the case (including Hick's claims agains directors/ RBS) to heard because it has the most real and substantial connection with the facts of the case.

The directors and RBS are very well represented and I am sure that they knew that this would be a possibility.

Just sit back and watch it all play out knowing that the Yanks will be gone soon. It's very rare to see such drama unfold in real life.
